*NOTE: i'm unsure if this is against the board "Laws"..lol so if it is please DELETE!*

well i think ONLY if it's an EMU that doesn't allow CD-R's/ISO's (if a PS1/Dreamcast/Sega Saturn EMU) or that if a "V-Modchip" allows it to play in that case it should be so if that is used the emu goes corrupt.

Well, downloading console or pc software that is licensed and sold on a retail market is illegal. period.

You are, however, legally entitled to 1 (one) backup, made by yourself, of any softare you own. More than 1, or distributing that copy can land you in federal prison. The law actually states that, technically, you aren't even allowed to let someone (i.e. a friend) borrow said copy.

A lot of rom/emulation sites state that if you own the original game then it is legal to download. IT IS NOT. The law does not say that.

That depends. For example, a friend of mine who had a game was fined a few hundred bucks for one game. But at the same time, another person I know is serving 3 years in prison (he couldn't pay the $4,000,000 fine) for stealing thousands of dollars worth of software.

The bottom line is: DONT DO IT!

i havent heard of someone getting put in jail for downloading PDR's (Public Domain Roms aka. games you created.)

It wasn't a PDR. It was a regular production game, and therefore was illegal as hell.

I don't think it's legal if ANYTHING. I think it's completely illegal. I've just started noticing warnings in instruction booklets, too. Here's one for example:

"WARNING: Copying of any Nintendo game is illegal and is strictly prohibited by domestic and international intellectual property laws. Back-up or archival copies are not ayuthorized and are not necessary to protect your software. Violators will be prosecuted."

Seems it's illegal no matter how you look at it.

um... yeah downloading/buying a game/CD that you didn't pay for that you usually have to or downloading/buying a game/CD that is a burned/ripped copy is illegal.

Depends, what games are you talking about? The games we're discussing here are things like Nintendo or Playstation games being illegally downloaded and played on your computer.

As for my own opinion on the matter, I think it's absolutely illegal. Of course, that doesn't stop me any more than it stops me downloading fansubs and mp3's.

Couldn't of said it better myself.

It's true about that but i only did it for games i already own so i can take them on the road with me for example..i went on vaction and used an emulator to play ogre battle 64 person of lordly caliber... its a rare game but i own it. seeing that i don't want to take a rare game with me i take the expendable emulator instead.
